The following is a general checklist for preparing the Power of Attorney document:
· Determine if the powers granted should be durable or non-durable.
· Clearly describe the powers that are granted along with any restrictions.
· If you have more than one Power of Attorney, then clearly define the powers that are granted to each agent to avoid conflict and confusion.
· Review other executed Powers of Attorney to check for inconsistencies.
· Clearly describe what events will trigger a Springing Power of Attorney.
· Clearly describe the conditions under which the Power of Attorney will expire (expiration date, specific conditions).
· Name a secondary agent to replace the primary agent if necessary.
· Notarize the Non-Durable Power of Attorney, even if this is not a requirement of the state where it will be operative.
